Terms of Service
- Your files are yours. We store them encrypted and cannot read them.
- Only you can get back into your box. Keep your password and recovery words safe: if you lose both, we cannot recover your files.
- Do not use HakoDrive for anything illegal or to harm others.
- Plans are paid through the App Store and renew until you cancel.
1. Agreement
These terms are an agreement between you and [Company legal name] ("HakoDrive", "we"). By joining the waitlist or using HakoDrive you agree to them and to our Privacy Policy.
2. Who can use HakoDrive
You must be at least 13, or the minimum age for online services in your country, and able to agree to these terms. One person per account.
3. Your account and your keys
- Your files are encrypted on your devices with keys that only you hold. We do not have a way to open your box.
- You can get back in with your password, your 24 recovery words, or a device that is already signed in. If you lose all of them, your files cannot be recovered by anyone, including us.
- You are responsible for what happens on your account and for keeping your devices, password and recovery words safe. Tell us at once if you think someone else has access.
4. Your content
You keep all rights to what you store. You give us only the permission we need to store, copy (for backups) and deliver your encrypted files to you and to people you choose to share with. You confirm you have the right to store and share what you upload.
5. Sharing
When you share a link or a folder, anyone with access can view, download or (if you allow it) add files. You are responsible for who you share with. You can stop sharing at any time; copies others already downloaded stay with them.
6. What you must not do
- Store or share anything illegal, including child sexual abuse material, which we report to the authorities when we become aware of it.
- Share material that infringes others' rights, harasses or threatens people, or contains malware.
- Try to break into other accounts, overload or attack the service, or get around storage limits.
- Use the waitlist or referral program with fake or automated sign ups.
Because content is encrypted, we act on reports and on information we lawfully receive. We may pause shared links that are reported, and suspend or close accounts that break these terms.
7. Free storage and referrals
- Every account gets 5 GB free.
- You get 5 GB more, up to 10 GB free in total, when a friend who joined with your invite link starts a paid plan and keeps it past the refund period.
- We may change or end the referral program, and remove referral storage gained through fake or self referrals.
- Free accounts unused for 12 months may be closed after we email you twice, at least 30 days apart. Paid accounts are not affected.
8. Paid plans
- Plans are sold through the App Store (and Google Play when Android launches). Prices are shown before you buy and include taxes where required.
- Plans renew automatically until you cancel in your App Store settings. Refunds follow Apple's or Google's rules.
- If a plan ends and you use more than the free space, your files stay safe and readable, but you cannot add more until you free space or choose a plan.
- Founding price: the first 100 people on the waitlist who start a paid plan within [60 days] of their invite keep that price while their plan continues without a break. Places on the list can change through referrals, and we may remove fake entries.
9. The service
We work to keep HakoDrive available and your files safe, but the service is provided "as is", may change, and may sometimes be unavailable. Early versions may have bugs. Keep another copy of anything irreplaceable until you are confident HakoDrive works for you.
10. Ending your account
You can delete your account at any time in Settings. We may suspend or close accounts that break these terms or the law, and will tell you when we can. If we ever close HakoDrive, we will give at least 60 days' notice so you can download your files.
11. Liability
To the extent the law allows, HakoDrive is not liable for indirect or consequential losses, or for loss caused by lost passwords and recovery words. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be limited.
12. Law and disputes
These terms are governed by the laws of [Hong Kong SAR]. Before going to court, please email us so we can try to sort it out. Consumers keep the right to bring claims in their own country where the law allows.
13. Changes
We will tell you about important changes in the app or by email at least 30 days before they apply. If you keep using HakoDrive after that, the new terms apply.
